1. Acceptance of Terms

By registering for an account, submitting a listing, or using HorseSales.ie in any way, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy.

2. About HorseSales.ie

HorseSales.ie is owned by Lucas IT Services, based in the Republic of Ireland. We provide a free online platform where individuals can post classified advertisements for horses and equine animals. We are not an auctioneer, dealer, agent, or broker. We have no involvement in any transaction between a buyer and seller.

3. Eligibility

• You must be 18 years of age or older to create an account
• You must reside in or have a legitimate connection to Ireland
• You must provide accurate registration information
• One account per person/entity

4. Listing Rules

By submitting a listing, you confirm and warrant that:

• You are the legal owner of the horse or have the right to sell it
• All information in the listing is accurate and not misleading
• The horse is accurately described (age, height, breed, temperament, health, vices)
• The horse has a valid passport (required by law in Ireland under SI 189/2014)
• The horse is microchipped where required
• Foals are at least 6 months old before being listed for sale
• The horse is not subject to any legal dispute or restriction
• The asking price is genuine and not fraudulent

5. Prohibited Listings

The following are strictly prohibited:

• Horses being sold on behalf of someone else without permission
• Stolen horses
• Horses in poor health deliberately misrepresented as healthy
• Foals under 6 months old
• Duplicate or spam listings
• Listings with fraudulent contact information
• Any listing that violates Irish or EU law
• Listings where the purpose is to facilitate animal cruelty or neglect

6. Our Role — Listing Platform Only

HorseSales.ie is a neutral platform. We:

• Do not verify the accuracy of listings
• Do not inspect horses
• Do not take part in negotiations or sales
• Do not handle payments
• Do not guarantee the health, description, or availability of any horse
• Are not responsible for disputes between buyers and sellers

7. Buyer Responsibility

Buyers are solely responsible for their own due diligence before purchasing any horse. We strongly recommend:

• Viewing the horse in person before agreeing to purchase
• Requesting an independent pre-purchase veterinary examination
• Verifying the horse's passport and microchip number
• Not making any payment until you are fully satisfied
• Never paying by bank transfer to someone you haven't met in person
• Seeking legal advice for high-value purchases

8. Seller Responsibility

Sellers are fully responsible for:

• The accuracy of all information in their listing
• Complying with the Animal Health and Welfare Act 2013
• Complying with equine passport regulations (SI 189/2014, SI 601/2014)
• Any legal obligations relating to the sale of horses in Ireland
• Any disputes arising from their listing

9. Business & Service Listings

HorseSales.ie also hosts a free directory where businesses and individuals can list horse and donkey related services (e.g. livery, farriery, veterinary services, riding instruction, equine transport, feed suppliers, tack and saddlery, breeding services, and similar). This section applies specifically to those listings, in addition to the general Terms above.

9.1 Business / Trader Status

Listings in the services directory are business (trader) listings, not private-sale advertisements. Consumer protection rights under Irish and EU law (including the Consumer Rights Act 2022) may apply differently to contracts you enter into with a business found through HorseSales.ie than they would to a private sale. HorseSales.ie is not a party to any such contract.

9.2 Self-Declaration — No Verification by HorseSales.ie

By submitting a business/service listing, you confirm and warrant that:

• You are legally entitled to provide the advertised service in Ireland
• You hold any licence, registration, qualification, authorisation, and insurance legally required to provide it — including, where applicable, registration with the Veterinary Council of Ireland (Veterinary Practice Act 2005) for veterinary services, or DAFM transporter authorisation for commercial equine transport under EU Regulation 1/2005
• All information in the listing, including geographic coverage, is accurate and not misleading
• You will comply with all applicable Irish and EU law in providing the service, including animal welfare, health and safety, consumer protection, and data protection law in respect of your own customers

HorseSales.ie does not verify any professional registration, qualification, insurance, or credential claimed in a business listing. Listing approval by our admin team is a basic content review only, not a certification, endorsement, or recommendation of the business or its competence.

9.3 No Endorsement or Liability

HorseSales.ie does not recommend, endorse, or guarantee the quality, safety, legality, or suitability of any business or service listed. We are not a party to and accept no liability for any transaction, contract, dispute, injury, loss, or damage arising from your use of, or dealings with, any business found through HorseSales.ie. You are solely responsible for carrying out your own checks — including verifying professional registration, insurance, and references — before engaging any listed business.

9.4 Indemnity

If you submit a business/service listing, you agree to indemnify and hold harmless HorseSales.ie, Lucas IT Services, and their operators against any claim, loss, liability, cost, or expense (including reasonable legal fees) arising from or connected to: your listing content; your provision of the advertised service; any breach of the warranties in Section 9.2; or your failure to hold any licence, registration, qualification, authorisation, or insurance legally required to provide that service.

9.5 Free Listing, No Guarantee of Results

Business listings are free. We do not guarantee any minimum level of enquiries, views, or business as a result of listing, and reserve the right to reject, edit, suspend, or remove any business listing at our sole discretion, without notice or reason, in the same manner as described in Section 12 below.

10. Listing Approval and Duration

All listings are reviewed by our admin team before going live. We reserve the right to reject or remove any listing at our sole discretion without notice or reason. Approved listings are live for 21 days from approval. After expiry, listings are archived but not immediately deleted.

11. Limitation of Liability

To the fullest extent permitted by Irish law, HorseSales.ie shall not be liable for:

• Any loss arising from reliance on listings
• Fraudulent listings or scams perpetrated by third parties
• Any transaction between buyers and sellers
• The health, welfare, or condition of any horse advertised
• The quality, safety, legality, or professional competence of any business or service found via our services directory, or any transaction, injury, loss, or damage arising from your dealings with a listed business
• Any indirect, incidental, or consequential loss

12. Intellectual Property

By submitting listing content and photos, you grant HorseSales.ie a non-exclusive, royalty-free licence to display that content on the site. You retain ownership of your content. You confirm you own or have rights to any photos you upload.

13. Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms, post fraudulent listings, or misuse the platform — without notice and without liability.

14. Governing Law

These Terms are governed by the laws of the Republic of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
